Service of Process in Pennsylvania

Service of process is the formal delivery of court papers — the mechanism Pennsylvania courts use to put a business on legal notice that it is being sued, subpoenaed, or otherwise drawn into a proceeding. Every LLC, corporation, and foreign-qualified entity on file with the Department of State designates a registered agent specifically to accept these documents.

What Counts as Service of Process

• Summons and complaints that open a lawsuit against your entity
• Subpoenas compelling records or testimony
• Restraining orders and injunctions
• Writs of garnishment or execution
• Court notices tied to an active case

Many of these carry hard response deadlines — a complaint can give you as little as a few weeks to answer, depending on the court. Miss that window, and a judge can enter a default judgment without ever hearing your side.

How Pennsylvania Handles It

Pennsylvania law requires every registered business entity to keep an agent on file at a physical, staffed in-state address — a PO box does not satisfy the requirement. Process servers and sheriffs deliver legal papers to that address, and the agent is responsible for accepting them during normal business hours. Pennsylvania also formally recognizes Commercial Registered Office Providers (CROPs), giving businesses a state-sanctioned professional alternative to self-appointing.

Why Self-Appointing Carries Risk

Naming yourself or an employee as agent is legal in Pennsylvania, but it puts the burden of same-day availability on one person:

Being served in person is disruptive. Process servers show up unannounced, sometimes in front of clients, employees, or family.
